There is a difference between a foreclosure, REO (Real Estate Owned) and a short sale.
A foreclosure is when the bank has gone through the legal process and has taken possession of the property. At the trustee's sale, people can bid on the property on the court house steps for cash (cashier's check in hand). Foreclosure sales begin with a minimum bid that includes the loan balance, any accrued interest, plus foreclosure costs; attorney's fees and anything else associated with the foreclosure process. These are CASH sales - no loans. If you are the winner of the bidding process, you will receive the property in "as-is" condition. There may be other liens against the property.
An REO (Real Estate Owned) is a property that goes back to the lender after an unsuccessful foreclosure auction. The bank now owns the property and the mortgage loan no longer exists. They often work with REALTORS® to sell the property. As a purchaser of an REO property, the buyer will receive a title insurance policy and the opportunity to investigate the property. If you decide to write an offer on one of these properties, you are negotiating directly with the bank and they want these properties sold and off of their books. These properties are featured on my web site as Foreclosures.
A short sale is where the owner of a home is trying to negotiate with their mortgage company to accept a lesser pay off than the homeowner owes. The offer is subject to lender(s) approval. Short Sales are a very complex transaction.
